How to increase the chances of success of complaints?
If you are an IPR owner or authorized to file complaints based on IPR through IPP platform, it will help increase the chances of success if you select appropriate reasons for filing complaints and providing sufficient evidence in support of your complaints.
For example:
If a seller party being complained of has their own brand A, but it also uses your trademark in their product name in such a way that leads to consumer confusion, you can choose the complaint reason of “ Free riding”.
If a seller being complained of uses your trademark and alleges the product bearing your trademark to be originated from you, while the product in fact is not manufactured or authorized to be manufactured by you, you can file a complaint based on “Counterfeit” and provide relevant proof of counterfeit.
