Interpretation of Complaint Reason

  Definition
The rights holder claims that the seller is selling pirated products by comparing the pictures or description of the product offered for sale with a genuine product and demonstrating that there are obvious differences between the product offered for sale and the genuine product.
  Case Study
The rights holder is the owner of the copyrighted works A, but the seller being complained of copies the copyrighted works A and offered for sale their product B which are not produced or authorized to produce by the rights holder, while there are obvious differences between product B and rights holder’s copyrighted works A. In such circumstances, the rights holder of copyrighted works A could submit copyright complaint based on the reason of Piracy Features by demonstrating the differences between the product B and the copyrighted works A produced by rights holder via the product images comparison with pertinent explanation and/or other supporting evidence.
In case the type or model of the product offered for sale with copyright A was never produced by or produced under authorization of rights holder, it can be complained of based on “This model or type does not exist”.
  Example
Below please refer to the pirated books (Fig.1 Pirated book) for sell and genuine books (Fig.2 Genuine book).

From the above, the seller’s product for sale can be determined as piracy products based on the comparison of the product image or description with the copyrighted works A. The rights holder could submit the complaint based on Piracy Features and provide the supporting evidence. The supporting evidence should include the information as below:

① The comparison of images between pirated products and copyrighted works A from the same angle.
② Provide relevant comments to specify the differences of pirated products and copyrighted works A.

· Complaint reasons: Please describe the features of the infringement. (E.g. We verified the products for sale are pirated products, because it was indicated as “collective edition” and “Recommended book of National courses” which are not revealed in the copyrighted works A)
· Supporting evidence: Please provide the comparison document and elaborate in details the difference(s) between the copyrighted works A and the suspicious pirated product. You may refer to the sample of comparison description as below:

  Complaint submission instructions
Please log into Alibaba IPP Platform (Complaint Submission-Submit a Complaint) and choose the pertinent platform. For example, for filling complaint against products on Taobao.com, please choose "淘宝网Taobao.com".


Subsequent steps of the complaint submission should be completed as below:
1. IPR: "Copyright", please choose the corresponding copyright information. (Note: Please note that takedown requests against Taobao listings should be filed based on valid intellectual property rights under protection by PRC laws.)
2. Complaint type: Please choose "Product listing".
3. Reason: Please choose Piracy Features.
4. Infringing listings: Please submit and verify URL of the suspicious infringing product listings.
5. Supplement infringement reason(s): Please describe your complaint reasons and identify where the infringement is.
6. Documental proof of infringement: Please submit supporting evidence to demonstrate the infringement.

Q: What’s the requirements of the supporting evidence to prove piracy infringement?
